Terms and Conditions

Please read these Terms and Conditions carefully as they affect your rights and liabilities under the law. The terms and conditions in relation with the website’s prices, delivery details and privacy policy are needed to be agreed upon by both parties relating to the supply of the goods to you by us. If you disagree with any part of the terms then you may not access the Service. We reserve the right to change or vary these Terms and Conditions from time to time. Any such change will take effect immediately upon posting on Choyskitchenadventures website. 

Definitions

In this given agreement, when using the pronouns:

“We”,”us” or “our”, means Choy’s Kitchenware. 

“You” or “your” means the person or party using the website. 

‘Choy's Kitchen Adventures website’, ‘Website’ means choyskitchenadventures.com as operated by us.

‘Working day’ means any day other than a Saturday, Sunday and a holiday in the United Kingdom.

Registration

1.1 You must be at age 16 to complete the registration procedure to be eligible to participate in the choy's kitchen adventures website service.

1.2 Ensure all details are reliable 

1.3 You must be aware of the responsibility you are entitled to uphold when a detail changes in Your user profile.

Pricing and Product Availability

2.1 The items are inclusive of VAT(Value Added Tax) and exclusive of delivery charges.

2.2 Pricing is subject to change without notice.

Payment

3.1 We do not accept any payment supplied by cash or cheque. Customers can checkout with major credit or debit cards.

3.2   During checkout, you authorise your payment facility. Payment will usually be taken on the day or the day after receipt of your order but only after orders have been checked. 

3.3 Upon the delivery of the goods, the risk shall pass on to you. This means that you shall be responsible for any damage or deterioration.

Delivery

4.1 Orders are processed within 1-3 working days upon receipt of the order, However, it subject is affected by the delivery option chosen. 

4.2 Any order made after 11am and on any other day that is not a working day shall be processed on the next working day.

4.3 Any orders which are made on the Friday using the overnight shipping service will not be dispatched until the next working day (Monday)

4.4 Goods ordered will be delivered to the shipping address specified by you on the order form.

4.5 Any changes to the order must be made before the order is dispatched. Changes after will not hold us liable.

Amendment of orders

5.1 We reserve the right to cancel your order if you fail to make the payment in time. 

5.2 Should there ever be a need to amend an order prior to its dispatch, it can be made via e-mail or telephone with your unique reference number.

5.3 Your order will be placed on hold, until the amendment requested by you is agreed by us. We reserve the right to cancel or refuse any amendment.

Returns/Exchanges

6.1 A return claim can only be accepted within 7 working days from the date of the invoice.

6.2 All returns or exchanges can only be authorised by us.

6.3  You are responsible for the delivery charge and this will be deducted from your payment regardless of the status of the return or exchange of the goods. 

6.4 We will hold the right to refuse any and all exchanges/returns, due to any reasonable or unethical reason.

Out of Stock Products

7.1 While we try to update our stock, there is a possibility that the stock becomes unavailable as you put in the order. We will give you the choice to replace the purchase with an alternative product instead.

7.2 We apologise if goods are out of stock, this is due to the pandemic's logistic restraints. We really appreciate your understanding.  

Complaints Procedure

8.1 Our goals are always in line with your satisfaction. If at any given time you feel unsatisfied with our service, please put your complaints via email or post.

8.2 After which we will suggest a way to address your complaints to your satisfaction.

Liability

9.1 If any given goods are incorrect, given in the wrong quantity or damaged in any sort of way, please report to us via email within 7 working days. Any further will shift the legal liability from us to you.

9.2 If any goods are not delivered to you within 21 days since the order was made, please lodge a formal complaint as soon as you can. We will not have any liability unless you have made a formal complaint via email within 30 days since your order. If a problem has been notified we can take action based on your choice as follows:

  • To rectify any issue with non-delivery. 

  • To replace or repair any damaged goods that were delivered.

  • To refund the money paid by you for the given goods.

9.3 We will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.

Events that are out of our control

In any given time, should a good be damaged/delayed or lost due to  environmental reasons such as strikes, lock-outs and other industrial disputes, breakdown of network or physical systems, flood, fire, explosion or accidents, we are not liable as these events are out of our control.

You acknowledge and agree with the terms and conditions of this agreement.


Third Party Rights

A person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us. 

Entire Agreement

These terms and conditions set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by anyone on our behalf should be understood as a variation of these terms and conditions or as an authorised representative about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
